The Canada Consumer Protection Act is back with a new name. On Wednesday, June 9th, Health Minister Leona Aglukkaq introduced Bill C-36, replacing the defeated Bill C-6. Bill C-36 is a proposed “modernization” of the Consumer Protection Act which will give government inspectors and agents more powers and consequently remove rights and freedoms from individual Canadians.

If you have been following the past incarnations of Bill C-36 you know what I’m talking about. Bill C-51 and C-52 contained language and provisions that were very disturbing and allowed for actions to be taken against individuals without legal recourse and without regard to “the rule of law”.

The Stop Bill C-51 movement received mainstream media attention and demonstrated to the Conservative Government that a significant number of Canadians are not in favour of this type of draconian legislation in Canada.

Constitutional lawyer Shawn Buckley has authored discussion papers on Bill C-51, C-52 and Bill C-6 which can be found at the Natural Health Product Protection Association’s website. Shawn Buckley is currently reviewing the newly tabled Bill C-36 and will present his analysis soon.

So far we have been lucky. Bill C51 and C52 were killed when the election was called. Bill C6 was stopped by the Senate and sent back to the House of Commons for amendment. Thanks to the hard work of Canadian Health Freedom Fighters and others who value freedom of choice and individual rights, the Senate heard loud and clear that this type of legislation is unacceptable. It also helped that we had a Liberal Senate while Bill C6 was under review in the Senate. This is not the case now that Prime Minister Stephen Harper has stacked the Senate by appointing more Conservative Senators. With a Conservative Majority it will be very difficult to fight Bill C36 in the Senate. The battle will have to be won in the House of Commons.

We should learn from the Fight the HST Campaign which is a very well organized and effective campaign to stop the HST in British Columbia. Bill C-36 can be defeated if enough people let the government know that they don’t support this type of regulation.

The documentary that exposed the food industry as a group of giant corporations running factory farms at the expense of the animals and human health has been nominated for an Oscar. Up for best documentary, Food.Inc paints a dreary picture of what is really on our dinner plates and exposes the social costs and animal cruelty you won’t read about on the food package label.

The Big Agri industry has avoided this kind of exposure to the extent that they have lobbied the government to pass “food libel laws” effectively making it illegal, in the United States, to criticize the industry for their practices.

Food libel laws, also known as food disparagement laws and informally as veggie libel laws, are laws passed in 13 U.S. states that make it easier for food producers to sue their critics for libel. These 13 states include Alabama, Arizona, Colorado, Florida, Georgia, Idaho, Louisiana, Mississippi, North Dakota, Ohio, Oklahoma, South Dakota, and Texas. [1] Many of the food-disparagement laws establish a lower standard for civil liability and allow for punitive damages and attorney’s fees for plaintiffs alone,[2] regardless of the case’s outcome. [3]

The most notorious case of “veggie libel laws” in action is when Oprah Winfrey dared to share her opinion about the beef industry and mad cow disease on her popular talk show. She went through a long period of litigation for daring to speak the truth as she saw it. The media covered this case extensively.

Food Inc. exposes the dangers of factory farming and the disparity between the marketing message we see in advertising and the reality of the industry. The advertising message we see is a traditional farm with the red barn and cows out to pasture. This type of farm, is being systematically put out of business and replaced by large scale mass production factories where the welfare of the animals and the nutritional value of the food is ignored in favour of low production costs and efficiency.

Food Inc. doesn’t complain about our food supply without offering a solution. They point out what consumers can do to make a change because in the end every dollar spent on food is a vote for the type of food we want them to produce for us.

I enjoyed this documentary as an informative and entertaining expose on the truth of what is going on behind the factory walls.

I am hoping Food Inc. wins the Oscar and gets more exposure as a result. Although, Food Inc. is up against another great documentary, “The Cove”, which exposes the dolphin massacre in Japan and the mercury contamination problem we are facing in our seafood.

Health authorities in British Columbia have their sights set on a small Raw Milk Dairy in Chilliwack. The Home On The Range Dairy has been producing raw milk without incident for a number of years now.

BC’s top health officer, Dr. Perry Kendall warned consumers that a sample of products tested by the BC Centre for Disease Control including raw milk, yogurt, cream, butter and cream cheese were contaminated with fecal matter.

The BC Centre for Disease Control refused to give the samples back so they could be retested to prove that they contained pathogens. They destroyed the samples and are not releasing the lab results. Home On The Range is accusing the BC Centre for Disease control of obstructing justice.

Kendal says drinking unpasteurized milk can cause serious illness, long term diseases or death. He says raw milk products are epecially dangerous fro young children, seniors and those with weakened immune systems. Kendall says so called health benefits of drinking raw milk are offset by the many serious illnesses and that there is no scientific evidence that raw milk is healthier than pasteurized dairy products.

It has been well publicized by Health Canada and other public health authorities that unpasteurized milk has the potential to contain “bad bacteria” but what they are not publicizing is that it contains many “good bacteria” and many beneficial enzymes and nutrients which have documented health benefits.

Home On The Range Dairy was set up as a “cow share” program. This means that individuals purchase shares in a cow and drink their share of the cows milk. They have been operating legally without any problems until July 9, 2008 when the Fraser Health Authority served them with an Order to Cease and Desist “distributing” raw milk. On March 18th 2009 a second Cease and Desist order was given to their depot in Abbotsford. They are appealing to the Supreme Court of BC for both orders. Meanwhile, while being careful not to breach the cease and desist orders “Real Milk” is still flowing in BC.

In other countries Raw Milk can be sold at farmers markets or other distribution points with a warning on the label making consumers aware that Raw Milk may contain harmful bacteria. This kind of regulation makes sense and is used on tobacco and alcohol products which are far more dangerous to consumers than raw milk.

Truehope Challenges Health Canada in Federal Courts Claiming Constitutional Breach

Calgary, AB
A small Alberta vitamin and mineral company called Truehope will finally have its day in court beginning Monday, November 2 when the Federal Court in Calgary will determine the legality and constitutionality of Health Canada’s 2003 seizure of a vitamin and mineral combination (EMPowerplus) being used by thousands of Canadians for the prevention of bipolar symptoms.

Years of court battles over the seizure that left hundreds of desperate Canadians caught in the middle of a regulatory battle have, thus far, amounted to nothing but a huge waste of tax payer dollars. In 2006 Health Canada charged Truehope owners with the illegal sale of a drug, but the courts found them innocent of all wrong doing and demanded the Truehope vitamin and mineral supplements continue to be made available to Canadians. Furthermore, in his final judgment, Judge G.M. Meagher concluded that even as Health Canada agents were denying access to the supplement they were fully aware that their actions would result in harm or danger to those who depended on the product for their health.[1]

Truehope co-founder Anthony Stephan claims that if the constitutional challenge is successful Health Canada will no longer be able to remove a product from the market without first proving in court that the removal will not harm Canadians who use it for their health. “Canadians are harmed when viable natural treatments or preventions are taken away. Drugs should not be the only option for Canadians who choose health. The judgment will extend protection to all Canadians and to all natural health products.”

Current Health Canada regulations allow bureaucrats to remove natural products at will without any accountability to Canadians for their actions.[2] “We think this kind of unconstitutional free-for-all opens the door for corruption and for big pharma lobby, and closes the door on individual freedom and choice in personal health care,” says Stephan.

WHAT’S WRONG WITH BILL C-6 AND DEMANDS EXPLANATION:

1. “For the first time in Canadian history”, lawyer Shawn Buckley explains, “Bill C-6 not only abolishes the law of trespass, but also allows warrants to be issued to search private homes without evidence of criminal wrong doing … in violation of Section 8 of the Charter.” What ?!

2. Under Bill C-6 (various sections) , “guilt (of anybody considered to violate this act, if the Minister thinks this is so) is determined by the Minister”, not by the courts! (As was the case for the past thousand yearssince England’s Magna Carta). Since when has any minister greater powers than the courts of the country? Since when is any government official, elected or otherwise, above the law?

3. Bill C-6 , in its preamble on page 1 and again in Section 2 (e) and (f), defines our government as including “a government of a foreign state or of a subdivision of a foreign state”, and “an international organization of states”. Canadians cannot question (or vote out) foreign governments. Canada has the right to enter into treaties – if our elected representatives agree to it, and we have the right to change or rescind such treaties by turfing out our government in the next election – but we did not give our government the right to change the very definition of what we own.

4. In Bill C-6, under Section 36 (2) (a) “any regulation made under this Act may be incorporated by [not by us the voters, but by]… a person or body (who the heck is this?) other than the Minister [i.e. a Canadian, elected MP], including by an organization established for the purpose of writing standards [ Codex? What organizations? Where?] … an industrial or trade organization [on whose boards we don’t sit, whose products we may not want, e.g. pesticide companies etc], or a government” [which one or ones?]. Forget the explanation/doublespeak – REMOVE this section immediately.

Whatever else Bill C-6 states and no matter how benevolent its intended protections – nothing warrants the removal of basic rights, the subversion of the Constitution, the usurpation of our courts, and the dis-empowering of Canadian citizens. C-6 CANNOT be amended – it must be withdrawn totally. Any other bill, containing those provisions, already passed or currently proposed, must also be withdrawn.

In A REPORT TO THE CONSUMER (Sept., 75), a long time friend, the late much loved Ida Honorof, presented a compilation of data from the National Institute of Health—Division of Biologic Standards, Bulletin of World Health Organization, and Dr. J. Anthony Morris, former Director of a branch of FDA Virus research. Dr. Morris’ findings showed that the flu vaccine, when inhaled by lab. animals “tended to enhance cancerous tumors.” Pregnant women had been on the preferred list for shots until findings indicated that certain substances in flu vaccine “could pose a serious threat of fetal damage to women who might become pregnant. . .”

Does anyone ever read the vaccine maker’s insert listing potential risks of side effects caused by the flu shot (all vaccines for that matter)?

Guillaume Barre syndrome is one of those dangers listed.
